Delhi High Court has directed social media platform Meta to present before the court the grounds for closing the Instagram account of stock market advisor Akanksha Gupta and restrictions imposed on other social media accounts. However, the court has currently refused to grant any interim relief to Gupta. The next hearing of the case will be in October.
Akanksha Gupta reached High Court against Meta
A bench headed by Justice Anup Jairam Bhambhani on Monday heard the case filed by Akanksha Gupta. Along with issuing summons in the case, the court has also issued notice on the application seeking interim relief.
Gupta told the court that she is a SEBI registered research analyst and gives advice related to the stock market. He is active on multiple social media platforms including Instagram, Facebook, X, and Telegram.
One Instagram account closed, action taken on other accounts
Senior advocate Dia Kapoor and advocate Nakul Gandhi, appearing for the petitioner, told the court that an Instagram account of Gupta has been closed. Apart from this, warnings or restrictions have been imposed on three other Instagram and Facebook accounts. Lawyers say that no clear reasons have been given for these actions, which is seriously impacting their professional work.
Meta explained the reason for the action
Advocate Varun Pathak, on behalf of Meta, said that users are informed about the reason for the action on their account itself. According to Meta, action was taken in this case based on alleged violations of Community Standards, including complaints related to solicitation of adult sexual activity and fraud. Meta also raised preliminary objection to the maintainability of the case. At the same time, the High Court has refused to grant interim relief at this stage and has asked to present the material related to Meta in the court.
