Delhi HC Rs 30 lakh fine on Google: Delhi High Court has imposed a fine of Rs 30 lakh on Google. Delhi High Court has imposed this fine in the case of misuse of trademark of knitwear company Hindware. Google will have to deposit the amount within 8 weeks. While delivering the verdict, the court said that Google is not just a passive intermediary but works as an active participant in the advertising system and also earns commercial profits. The case pertains to two commercial suits filed by Hindware Ltd in 2013-14.

Delivering the verdict, Justice Mini Pushkarna said that use of a registered trademark as a keyword also amounts to use in an advertisement, even if it does not appear on the advertisement page. The court said that Google suggests and sells the trademarked words to advertisers, which gives it direct commercial benefits.

Justice Mini Pushkarna said that Google’s argument that it only provides the platform cannot be accepted. Therefore, legal protection should be provided under the Information Technology Act. Google’s role is not limited to just a technical platform, as it suggests keywords, decides the ranking of advertisements and also earns revenue from it. The High Court restrained Google from using Hindware, Hindware Sanitaryware and other related names as keywords.

The amount will have to be deposited within eight weeks

The court has ordered compensation of Rs 15 lakh each in both the cases, a total of Rs 30 lakh in favor of Hindware. Google will have to deposit this amount within eight weeks.
