Delhi Riots Case: A hearing on the bail application of Umar Khalid and Sharjeel Imam, accused in the alleged conspiracy in the Delhi 2020 riots case, was held in the Karkarduma court today. But even this time the court rejected the bail application of Umar Khalid and Sharjeel Imam. After hearing arguments from both sides, the court reserved its verdict on Saturday. In the evening, a court headed by Additional Sessions Judge Sameer Bajpai denied bail to both the accused. Advocate Trideep Pais on behalf of Umar and Advocate Mustafa on behalf of Sharjeel presented arguments.
What was said in the bail application?
In their bail application, Umar Khalid and Sharjeel Imam argued that we have been kept in jail for a long time without trial, which is a violation of our fundamental right to personal liberty. Although the Supreme Court had earlier rejected our bail application, the subsequent judicial developments have changed the situation, he claimed.

Both cited the court’s observation in a separate case in May that the court held that bail should be the rule, not the exception, even under the Unlawful Activities (Prevention) Act (UAPA). After the Supreme Court denied him bail on January 5, he had filed this application afresh.
‘Lower court cannot interfere’: Argument of Delhi Police
Opposing the arguments of Umar and Sharjeel, the Delhi Police told the court that the existing order will remain in force until a different order is passed by a larger bench of the Supreme Court. Therefore, the lower court has no right to interfere in the matter, and if any relief or explanation is desired, the accused should appeal directly to the Supreme Court.
Meanwhile, the court had issued a notice to the Delhi Police on June 13. The accused then filed a fresh bail application claiming that six months after the Supreme Court rejected their application, there has been no significant progress in their case. It was also claimed that the arguments on framing of charges against him have not yet been completed.

Interim bail to some accused
On January 5, the Supreme Court had rejected the bail pleas of Umar Khalid and Sharjeel Imam. However, Gulfisha Fatima, Meeran Haider, Shifa-ur-Rehman, Shadab Ahmed and Mohammad Salim Khan were granted bail on the same day. Later on May 22, Khalid Saifi and Tasleem Ahmed were also granted interim bail for six months.
What is the matter?
Umar Khalid, Sharjeel Imam and several others have been booked under various sections of the UAPA as well as the Indian Penal Code (IPC) for allegedly being part of a larger conspiracy behind the February 2020 riots in Northeast Delhi. At least 53 people were killed and more than 700 injured in the violence that erupted during protests against the Citizenship (Amendment) Act (CAA) and the proposed National Register of Citizens (NRC).
