Demand to withdraw Supreme Court's decision on SIR, former judge Gopal Gowda made serious allegations against the Election Commission

New Delhi. Amid the ongoing controversy over the Special Intensive Revision (SIR) of voter lists, former Supreme Court judge V. Gopal Gowda has asked the apex court to reconsider and withdraw the decision given in May 2026. He alleges that the Election Commission did not present important facts correctly, which influenced the court's decision.

Justice Gowda says that the Supreme Court should take suo motu cognizance and ask for all the records related to this process from the Election Commission. This will make it clear whether the decision to conduct SIR was taken by the entire Commission or the Chief Election Commissioner took the decision without the consent of other Election Commissioners.

Questions raised on the commission's decision

The former judge questioned the decision-making process related to SIR, saying that if there was disagreement on the issue within the Commission and this fact was not placed before the court, then the matter should be reviewed again. He called the decision illegal and unconstitutional and appealed to withdraw it.

This controversy has come to light amid questions raised regarding the decision process within the Election Commission and the revised Form-6. Form-6 is related to registration as a new voter. In this case, the Supreme Court has already clarified that it had not approved any amendment made in Form-6.

Support for Justice Ujjwal Bhuiyan's statement

Justice Gowda also defended the remarks of sitting Supreme Court judge Justice Ujjwal Bhuyan, in which he had expressed concern over the possibility of voters being disenfranchised on a large scale. He said that speaking on issues related to constitutional rights should not be considered judicial impropriety.

This reaction was given by former Chief Justice B.R. This comes after criticism of Gavai. Gavai had said that judges should maintain judicial decorum while making public comments on a matter pending in the court.

Political controversy continues regarding SIR

The legality of special intensive revision of voter list in Bihar was upheld by the Supreme Court in May 2026. However, opposition parties and other groups have raised questions regarding this process. They allege that the process of scrutiny and deletion of names in the voter list may affect the rights of eligible voters.

At the same time, the demand for judicial review on the questions raised regarding the process of the Election Commission and its decisions has also intensified. After the demand of Justice Gowda, now the center of this debate is that under what process the decisions related to SIR were taken and how the related facts were placed before the court.
