In this case, the regulator has directed a builder in Mumbai to return Rs 5 lakh collected from a home buyer for clubhouse membership. The concerned buyer had taken possession of the apartment in October 2019. However, after more than 6 years of possession, the developer did not construct the promised clubhouse or make it available for use.

What was the builder’s defense?

Responding to the complaint, the developer argued that the project was part of a larger Integrated Redevelopment Scheme. The clubhouse is proposed as a shared facility for the entire layout. “The delay is due to the relocation of the BEST bus depot and the delay in getting clearances from various authorities. The developer claimed that the work on the clubhouse had not been canceled and that the charges had been levied as per the terms of the contract.

What decision was given by Maharera?

The ‘Maha-RERA’ rejected this argument of the developer. It is unfair not to provide the necessary facilities within a reasonable period even after the lapse of many years. Therefore, the ‘Maha-RERA’ ordered the builder to refund Rs. Due to this decision, the promises of the builders in the construction sector will come under pressure, and the customers have got a big relief.
