New Delhi:The dispute related to the demonstration at Jantar Mantar on October 3 in the capital Delhi has now reached a legal turn. An FIR has been registered on October 13 at Sansad Marg police station on the complaint of Assistant Police Commissioner Vivek Bhagat. In the complaint, independent journalist Rosie Gajendra Singh and some members of Cockroach Janata Party have been accused of making casteist remarks, publicly insulting them, obstructing government work and allegedly tarnishing their image on social media. The police is investigating the matter
Controversy started during demonstration at Jantar Mantar
According to the complaint, ACP Vivek Bhagat was handling the responsibility of maintaining law and order during the protest organized at Jantar Mantar against the Election Commission on October 3. Meanwhile, near Buta Singh roundabout, independent journalist Rosie allegedly made derogatory remarks about his caste and raised questions on his appointment to the post of ACP. Vivek Bhagat alleges that he ignored these comments and continued his government duty. The complaint further alleges that during the action to control and detain the protesters at around 3 pm, Rosie accused the ACP of sexual harassment. According to the ACP, Rosie and the people accompanying him repeatedly confronted him, creating obstruction in the discharge of government work.
Sloganeering and serious allegations outside the police station
According to the complaint, the same evening Rosie and others demonstrated outside the Sansad Marg police station and raised slogans against the ACP. Vivek Bhagat has alleged that during this period derogatory words were allegedly used against him and he was even called a sexual predator and a possible rapist. These allegations are yet to be independently confirmed.
Accused of circulating posts and reels on social media
The ACP, in its complaint, has alleged that Rosie, Gajendra Singh and some members of the Cockroach Janata Party circulated posts and reels on social media regarding the allegations related to them. The names of Rosie Gajendra Singh, Abhijeet Deepke, Ashutosh Ranka, Saurav Das and Ratna Singh have been mentioned in the complaint. The complainant claims that these activities caused him mental distress and damaged his social and professional reputation.
Under which legal provisions was the case registered?
As per the complaint summary available, the FIR mentions relevant legal provisions including the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act and Section 221, Section 356(2) and Section 3(5) of the Indian Judicial Code. These provisions relate to allegations of caste-based atrocities, obstruction of a public servant, defamation and common intention respectively. The complaint also said that a separate complaint of sexual harassment filed by Rosie had been sent to the Crime Branch of Delhi Police and was under investigation.
The picture will become clear only after investigation
In this entire incident, an impartial investigation into the allegations related to both the parties is important. The allegations made in the FIR registered on the complaint of ACP Vivek Bhagat are still under investigation. Mere registration of name in the FIR does not prove a person's crime. Further action in the case will be decided based on the findings of the investigation and available evidence.
