Policy Surrender: The Pension Fund Regulatory and Development Authority (PFRDA) has amended the rules regarding premature termination of the policy under the ‘Annuity’ i.e. annual pension under the National Pension System NPS. Now, if a subscriber or their family member is suffering from a serious illness. Then they will be able to surrender their policy and withdraw the amount. According to a circular issued on May 14, the PFRDA has clarified that ‘Annuity Service Providers’ i.e. ASPs will now be able to process policy surrender requests under certain circumstances. Moreover, annuity policies issued prior to PFRDA’s earlier circular dated October 24, 2024 can also be surrendered. But for that, the surrender provision must be clearly mentioned in the relevant policy. According to ET reports, under PFRDA’s October 24 circular, surrender of annuity policies was almost completely banned; The only exception to this was the ‘free-look period’. This restriction was put in place to ensure that subscribers continue to receive a regular income stream even after retirement.

Who got relief?

The PFRDA has again clarified that service providers will not allow surrender or cancellation of an ‘annuity’ i.e. pension plan, except during the ‘free-look period’ i.e. the initial few days after purchasing the insurance policy. The pension regulator further specified that the proceeds from such cancellation must be used only for purchasing a new annuity from the same service provider or from a different provider.

This relief is applicable in cases where the annuity holder or a member of his family is suffering from a critical illness. However, for the application of this rule, the concerned service providers shall verify whether the said illness is indeed serious as per their prescribed standards and policy guidelines. This relief also applies to annuity policies issued before 24 October 2024; But for that, the policy surrender option must be clearly mentioned in the relevant policy documents.

Changes in Annuity Policy Rules

PFRDA has amended the rules regarding surrender of Annuity Policy under NPS.
Members can now surrender their policies in case of critical illness of themselves or their family members.
Annuity Service Providers are now authorized to process surrender requests under certain circumstances.
This includes cases of critical illness of the Annuity holder or his family members.

What is the real reason behind this decision?

The decision was taken based on the feedback received by PFRDA, according to which the members were facing huge difficulties due to the existing restrictions. This was especially true for individuals who had old policies that originally had a provision for withdrawal under certain circumstances. Also, PFRDA was receiving applications seeking permission to surrender annuity in case of critical illness.
