The Allahabad High Court on Monday directed the Uttar Pradesh government to settle the family of the Hathras gangrape and murder victim in Ghaziabad or Noida within three months and make arrangements for their rehabilitation. The court found that the state government was creating “unnecessary obstruction” in complying with its earlier directions.
The bench of Justice Rajan Roy and Justice Jaspreet Singh said that the state government's decision taken on February 22, 2025, in which the family was offered to be settled in Kasganj, Etah or Aligarh, did not consider their demand to be settled in Ghaziabad or Noida. Therefore “it was not a decision in the eyes of law”.
The court also directed that the Additional Chief Secretary (Home) of the Government of Uttar Pradesh file a compliance affidavit and warned that if the direction was not complied with, he would have to appear in person. These instructions were given as part of the proceedings initiated by the High Court by taking suo motu in the matter related to the right to dignified funeral after the Hathras rape and cremation incident in 2020.
