The Delhi High Court on Monday directed the Delhi Police to consider and take a decision regarding permission for Karni Sena's proposed peaceful demonstration at Jantar Mantar on September 20. This petition was filed demanding permission for the demonstration. The petition seeks permission to organize a peaceful demonstration at Jantar Mantar on September 20 against the rules promoting equality in higher educational institutions recently notified by the University Grants Commission (UGC). The High Court has asked Delhi Police to consider the proposal of protest and take a decision as per rules.
The bench of Justice Swarnakanta Sharma has asked Kshatriya Karni Sena President Dr. Raj Shekhawat to file a fresh application before the Delhi Police with a revised date. His lawyer told the court that now the protest is proposed from 10 am to 5 pm on September 20. The bench directed that the fresh application be presented before the competent authority and a decision be taken on it by September 14, i.e. within a week. The court said that Delhi Police should take a decision on the application as per the rules applicable to it and if necessary, it can also impose appropriate conditions for the demonstration under the law.
Protest against new UGC rules, demand for withdrawal
Shekhawat said that the purpose of the proposed protest is to put forward their objections and grievances in a peaceful manner on issues related to reservation policies and the new structure of the UGC. Through the protest, a demand is being made to withdraw the UGC equity rules of 2026. On behalf of the petitioner, reference was also made to the order of the Supreme Court, in which the implementation of these new rules has been banned for the time being. The Supreme Court had decided to stay their implementation in view of the ambiguity in some provisions of the rules and the possibility of their possible misuse.
Shekhawat challenged the order of Delhi Police
Shekhawat says that his objection is also related to the same issues which have been highlighted by the Supreme Court in its order. According to him, important legal questions arise in this case, which need to be heard by a bench of three judges. The petition also challenges the communication issued by Delhi Police on August 28, in which permission for the proposed demonstration was refused. Shekhawat alternatively demanded from the court that the police should reconsider his application and issue a fresh order with reasons within 24 hours.
Three demands ineffective, petition disposed
The bench said on Monday that all the three demands made in the petition have now become ineffective. The court then directed the petitioner to file a fresh application before the Delhi Police with a revised date of protest. The case was disposed of after the court's instructions. Now Delhi Police will take a decision on the new application regarding permission for the proposed demonstration as per the rules.
