MCD notice creates panic among Delhi traders! The threat of seizure is haunting

The Municipal Corporation of Delhi (MCD) has issued a notice to shopkeepers, factory owners, banquet and hotel restaurant traders in the city, which may give traders sleepless nights. After this notice from MCD, traders are facing the threat of their business being seized. Today, on this issue, a delegation of Delhi’s business organizations under the leadership of CTI is meeting MCD Commissioner Sanjeev Khirwar at 12.00 noon.

Actually, it has been told through the notice that commercial work cannot be done on residential land. If this is happening then the shop or business will be sealed. This order has been given by the Supreme Court, which is necessary to follow.

According to the notice, the list of properties included in it is as follows-

  • All residential colonies, including unauthorized/regularized (sanctioned) colonies
  • Group Housing Societies and Plotted Developments
  • All areas under the jurisdiction of the MCD, including ‘islands’ or pockets which may technically fall outside the administrative limits but are geographically within or adjacent to the MCD areas

The notice reads- In this regard, you are directed to:

  • Carry out detailed field survey and verification in their respective areas
  • Prepare a comprehensive and area-wise list of all cases where residential premises are being misused for non-residential purposes
  • Ensure that the data collected is accurate, verified and supported by necessary records, as this data will form the basis of the affidavit to be filed before the Hon’ble Supreme Court
  • Fix responsibility at the appropriate level for any omissions or misreporting
  • The report prepared must reach the Additional Commissioner (Engineering) within 07 days, so that the process of compilation and filing of the affidavit can be completed, which will be personally verified by the undersigned.
