Madhya Pradesh High Court’s decision challenged in Supreme Court, special leave petition filed

Dhar Bhojshala Case: The much-discussed Bhojshala dispute of Dhar district of Madhya Pradesh has once again reached the doorstep of the country’s biggest court. The Muslim side has challenged in the Supreme Court the decision of the Indore bench of the Madhya Pradesh High Court to declare the disputed Bhojshala complex as the main temple of Maa Saraswati.

This is the petition

A special leave petition or SLP has been filed in the Supreme Court on behalf of Qazi Moinuddin, the caretaker of Kamal Maula Masjid. Through this petition, a demand has been made to immediately stop the decision of the High Court, in which it was said to give the right to worship to Hindus and ban the prayers of Muslims. The Muslim community hopes that they can soon get relief in this matter from the Supreme Court.

What was the big decision of the High Court?

The root of this entire controversy is the decision of Madhya Pradesh High Court, in which the court had decided the religious nature of this entire complex on the basis of historical and religious evidence. The High Court had clearly said that the religious character of the disputed monument is basically the Bhojshala, the temple of Vagdevi i.e. Mother Saraswati. Along with this, the court had also canceled the arrangement made by the Archaeological Survey of India i.e. ASI in the year 2003, under which Hindus were allowed to worship only one day a week and Muslims were allowed to offer namaz on Friday. The court had considered it wrong to limit the right of Hindus to worship, due to which the Muslim side has now taken refuge in the country’s biggest court.

Legal battle over claims of history and Namaz

Kamal Maulana Welfare Society President Abdul Samad has spoken in detail to the media regarding this legal battle. He says that the things and evidence which he could not present strongly before the High Court will now be presented before the Supreme Court. The main claim of the Muslim side is that Namaz has been offered in this complex in every period of history and they have solid evidence of this. Abdul Samad has expressed confidence that after the hearing in the Supreme Court, the situation will change in his favor and he will once again be able to start his prayers in this complex. He also made it clear that his society respects every sphere of law and is taking forward its views only under the rights given by the Constitution.

The administration did not give permission

The district administration appears to be fully prepared to ensure that tension does not increase at the local level amidst this legal turmoil. The Muslim community had sought permission from the administration for Friday prayers, but citing security and law and order, the administration rejected this permission. After this, the leaders of the Muslim community have appealed to their people not to protest of any kind and maintain peace. People of the society have been asked to offer Namaz at their homes or other private places. On the other hand, the Hindu side is completely excited at this time and preparations have been made by them to continue the religious rituals and pujas inside the campus.

Big appeal to maintain peace and law and order

Considering the sensitivity of the matter, representatives of the Muslim community have strongly appealed to the general public to maintain peace and brotherhood. He has said that whatever rule or order the court makes, it will be followed under all circumstances. Security arrangements have been tightened in Dhar city and surrounding areas to prevent any untoward incident. The eyes of both Hindu and Muslim parties are now fixed towards the biggest court of the country, where a very important hearing is going to be held in the coming days regarding the future of this historical and religious place.
