The Allahabad High Court, while rejecting the habeas corpus petition filed by a 25-year-old girl, said that an adult person cannot be forced to live with someone against his will.
Tezzbuzz Desk– Allahabad High Court clarified in an important order that parents cannot force their adult daughter to live with them against her will. Justice Sandeep Jain said that an adult person cannot be forced to live with a particular person against his express will, even if that person is his parent.
This case was related to the habeas corpus petition filed by Kalavati Devi. He had demanded that his 25-year-old daughter Kumari Pooja be produced before the court. On August 17, 2026, the court ordered the production of the daughter, after which Pooja was presented before the High Court. While talking to the court, Pooja told that she is living freely in Delhi on her own will and is not in any kind of illegal detention. She also made it clear that she did not want to live with her mother. Pooja alleged that her mother's behavior towards her was not good and she faced beatings and abuse in her maternal home.
However, the mother denied the daughter's allegations and expressed her wish that she stay with her in her maternal home. After hearing both the parties and talking to the daughter, the court accepted that Pooja is adult and capable and she has taken a conscious decision not to live with her mother. The court said that he is free to live at the place of his choice and with the person of his choice. On this basis, the High Court rejected the habeas corpus petition of Kalavati Devi.
