Pawan Kheda does not get relief from the Supreme Court, the sword of arrest remains intact, the court reprimanded regarding Aadhaar card
News India Live, Digital Desk: The troubles of senior Congress leader Pawan Kheda are not showing any sign of abating. The Supreme Court has refused to grant interim relief to Khera in the case of controversial comments and allegations against the wife of Assam Chief Minister Himanta Biswa Sarma. Justice Maheshwari’s bench rejected Pawan Kheda’s demand for anticipatory bail till Tuesday and advised him to approach the concerned lower court (Assam Court). What happened in the court? Why was ‘Aadhaar’ reprimanded? During the hearing, the Supreme Court expressed strong displeasure over the documents presented by Pawan Kheda’s lawyers. Mistakes in the documents: Justice Maheshwari said that the petitioner has tried to mislead the court. Pawan Kheda had used Aadhaar card to prove that he was a resident of Telangana. The court found that he presented the front of his Aadhaar card and the back of his wife’s Aadhaar card. Court’s comment: Justice Maheshwari termed it as presenting a ‘wrong document’ and reprimanded him. However, Kheda’s lawyer Abhishek Manu Singhvi clarified that the petition was filed in a hurry, hence it was a human error, which was later rectified. Singhvi’s argument and Supreme Court’s direction Abhishek Manu Singhvi argued that the Guwahati High Court will open on Monday, hence Kheda should be given security till Tuesday so that he can go to the High Court. But the Supreme Court clarified: Go to the lower court: Kheda should immediately apply for bail in the concerned court of Assam. Decision on merit: The Supreme Court made it clear that the lower court will take the decision on the basis of merit of the case without being influenced by any comment of the Supreme Court during the hearing on the bail application. What is the whole matter? This legal battle against Pawan Kheda starts with the allegations leveled on Riniki Bhuyan Sarma, wife of the Chief Minister of Assam. Hui: Allegation: Kheda had claimed that the Chief Minister’s wife has multiple passports of different countries and has illegal assets abroad. FIR: Terming these allegations as false, Assam Police had registered a case against Pawan Kheda under various sections of the Indian Justice Code (BNS), including defamation, cheating, forgery. Bail issue: Earlier, Telangana High Court had given Kheda one week’s advance notice. Bail was granted, which was stayed by the Supreme Court on April 15 after the appeal of the Assam government. Rahpavan Kheda now only has the option of getting relief from the concerned court of Assam or the Guwahati High Court. Assam Police is active in arresting him, hence the coming few days are going to be very challenging for him politically and legally.
