Petition in Supreme Court regarding lathi charge on students at Jantar Mantar, demand for judicial inquiry

Tezzbuzz Desk- A petition has been filed in the Supreme Court regarding police action against students and other protesters at Jantar Mantar in Delhi. The petition alleged that excessive force was allegedly used by the police during a peaceful protest. The petitioner has demanded the Supreme Court to take suo motu cognizance of this matter and conduct an independent investigation.

Advocate Narendra Mishra has filed a letter petition before the Chief Justice. It has been demanded that an independent judicial inquiry should be constituted under the supervision of the court or the investigation of the case should be handed over to an impartial investigating agency. Through letter petition, any person or organization can directly present his complaint before the court, which can be accepted by the court as a public interest litigation.

Allegation of violation of the constitution

In the petition, the Supreme Court has been requested to take suo motu cognizance of the alleged violation of Articles 14, 19 and 21 of the Constitution during the peaceful demonstration. The petitioner says that peaceful protest is the constitutional right of the citizens and investigation into the violation of this right is necessary.

In the petition, a demand has also been made to present all the records related to the action of Delhi Police before the court. This includes information related to police deployment, orders for use of force, CCTV footage, drone footage, body camera recordings, wireless logs and other documents related to the protest.

Demand to keep electronic evidence safe

The petitioner has sought instructions from the court to keep all digital evidence safe. This includes videos made from mobile phones, social media recordings, CCTV footage and records related to police communications.

A pen drive containing about 100 video recordings has also been submitted along with the petition. The petitioner has said that after examining all this evidence, it should be decided whether excessive force was used by the police or not.

Demand for action against the culprits

In the petition, it has also been demanded from the Supreme Court that if any person is found guilty in the investigation, then instructions should be given to register an FIR against him and initiate criminal action, regardless of his position or position.

Further, the petitioner has sought to identify those who allegedly attacked the plainclothes protesters. There has also been a demand to investigate whether they were acting under any official order or permission.

Demand for compensation to the injured

The petition also demands proper medical aid and compensation to those injured during the protest. The petitioner says that if any person has suffered harm due to illegal or excessive use of force, he should get relief.

Protests across the country regarding the demonstration

Protests have also taken place in other parts of the country in support of the demonstration at Jantar Mantar. Earlier, students, youth and elders had demonstrated in Nagpur in support of social activist Sonam Wangchuk and Cockroach Janata Party.

The protesters expressed their anger against the central government over the education system and alleged paper leak cases and demanded the resignation of Union Education Minister Dharmendra Pradhan. He said that the agitation will continue until their demands are met.

Now the further direction will be decided only after hearing this petition filed in the Supreme Court. The petitioner demands that the entire matter should be investigated impartially and action should be taken against those responsible as per law.
