Political battle over health insurance rules in America; 25 states’ lawsuit against Trump administration
New Delhi. Legal and political controversy has deepened in America regarding the new rules of Medicaid, the government health insurance scheme. 25 states and Washington DC have filed a lawsuit in court against the Trump administration. These states allege that the new work rules will make it difficult for those in need to obtain health insurance and that many eligible citizens may also be deprived of the benefits of the plan.
The controversy began after interim rules were issued by the Centers for Medicare and Medicaid Services, which operates under the US Department of Health. States say the administration has implemented new provisions that exceed the limits of the law enacted last year and have interpreted the law in a way that imposes additional conditions on beneficiaries.
According to the new rules, from January 1, people aged 19 to 64 who are covered under the Medicaid expansion plan will have to work at least 80 hours every month or do community service or study for half the time. However, a provision has been made to give exemption to seriously ill people, persons involved in de-addiction program and some other categories.
The biggest controversy is regarding the new definition of serious health condition. Earlier in the law, there was a provision to give exemption to people suffering from serious illness or drug addiction, but in the new rules it has been said that the disease should be so severe that the person’s ability to work, study or do community service is affected to a great extent. Only then will he be able to get exemption.
The states filing the lawsuit say that due to this new condition, cancer patients, disabled mental patients and people suffering from other serious illnesses will have to go through additional documents and a lengthy paperwork process to prove their eligibility. Due to this, many people who are actually entitled to it may be deprived of health insurance.
States have also alleged that the rules were suddenly changed after prolonged discussion, making it difficult to implement the new system at the administrative level. Also, it was not made clear under which process the proof of serious illness will be accepted.
On the other hand, the Trump administration says that the purpose of these rules is to prevent misuse of government schemes and to ensure that the benefits actually reach the eligible and needy people. However, after the lawsuit was filed, no official response has been given on this matter by the Health Department and the Centers for Medicare and Medicaid Services.
New York Attorney General Letitia James expressed concern over the new rules, saying people recovering from cancer, disability, mental illness or addiction should not be entangled in unnecessary paperwork to get treatment. According to him, these changes may affect the access to health services of thousands of needy people.
