Pawan Kheda got a shock from Guwahati High Court, anticipatory bail plea rejected, sword of arrest hanging.

New Delhi. Congress leader Pawan Khera has received a big blow from the High Court in the case of FIR lodged by the wife of Assam Chief Minister Himanta Biswa Sarma. His anticipatory bail plea has been rejected by the High Court (Anticipatory Bail Plea Rejected). Pawan Khera approached the High Court in the matter related to the FIR. Kheda had alleged that CM Sarma’s wife had multiple passports. Earlier the court had refused to grant him transit bail. Pawan Khera had demanded in the court that he should be given a few days time so that he can file a petition for regular bail in the Assam court.

What was Pawan Kheda’s argument?

Pawan Khera’s lawyer argued in the Guwahati High Court that there is no danger of the Congress leader fleeing the country and there is no need to arrest him. A single bench of Justice Parthiv Jyoti Saikia reserved its order after hearing both the sides for over three hours.

Senior advocate Abhishek Manu Singhvi, appearing for Kheda through video conference, argued that Chief Minister Sharma’s comments in response to the Congress leader’s allegations point towards political vendetta, especially in the context of the assembly elections in the state. Singhvi said that there is no danger of the petitioner fleeing the country and there is no need for his arrest.

Assam Advocate General Devajit Lon Saikia had opposed giving any relief to Kheda, saying that this is not an ordinary defamation case, as this case is related to forgery of documents. Saikia said the main crimes are related to fraud and forgery. He argued that Kheda was not entitled to interim protection because he was “at risk of fleeing the country”.

CM Sarma’s wife Rinki Bhuyan Sharma has filed criminal cases against Kheda and others under various sections of the Indian Justice Code at the Guwahati Crime Branch police station. The Telangana High Court had earlier granted seven days transit anticipatory bail to Khera, but the Supreme Court stayed the order. Let us tell you that this issue has become very hot during the Assam Assembly elections. After Congress’s allegations, CM Sarma directly targeted Pawan Khera.
