Supreme Court’s big order on Bhojshala controversy: ASI stopped from structural changes, important comment regarding Namaz also
New Delhi. During the hearing held on Monday in the Supreme Court regarding Dhar’s Bhojshala, many important instructions were given. The apex court has currently restrained the ASI from making any structural changes in the complex. However, Madhya Pradesh High Court has refused to put an immediate stay on the decision and has sought answers from all the parties.

Notice to Hindu party, government and ASI
A bench headed by Chief Justice Surya Kant, while hearing the petitions of the Muslim side, issued notice to the Hindu side, Madhya Pradesh government, district administration and ASI. The court said that the next hearing of the case will be in the third week of July. Till then there will be no stay on the High Court order, but no structural changes will be made in the premises.
Court’s interim suggestion regarding Namaz
During the hearing, the Muslim side raised the demand for resumption of Friday prayers. On this, the Supreme Court said that till the final decision is taken, instead of the Bhojshala premises, arrangements for Namaz can be made at some alternative place nearby between 1 pm to 3 pm on Friday. The court also made it clear that at present namaz will not be allowed inside the premises.

What did the Muslim side say?
On behalf of the Muslim side, senior advocates Huzaifa Ahmadi and Abhishek Manu Singhvi argued that Namaz was being offered here for about 40 years, but after the decision of the High Court, this arrangement was suddenly ended. He demanded the court to restore the old status quo.
The Supreme Court expressed surprise at an order of the High Court
During the hearing, the Supreme Court also raised questions on the instructions of the Madhya Pradesh High Court, which had asked to bring back the statue of Maa Vagdevi (Saraswati) from the London Museum. Commenting, the bench asked on what basis a constitutional court can give such an order.

The Supreme Court has issued notice to all the parties and sought answers. The next hearing of the case will be in the third week of July. Till then, while maintaining the status quo in the Bhojshala premises, ASI has been instructed not to make any kind of construction or structural changes.
