Sonam Raghuvanshi Bail Cancelled: Indore’s famous transport businessman Raja Raghuvanshi’s wife Sonam Raghuvanshi, accused in the murder case, has received a big blow from the Supreme Court. The country’s biggest court has completely canceled Sonam’s bail. Along with this, the court has given strict instructions to him to surrender in the concerned court within three weeks. With this big decision of the Supreme Court, this years old and much talked about honeymoon murder case which has been making headlines across the country has once again come into the center of discussion.
Meghalaya government had challenged the bail
A few days after the marriage, Raja Raghuvanshi, who had gone on honeymoon with her husband, was suddenly murdered. This entire incident shook the entire country. In this case, apart from Raja’s wife Sonam Raghuvanshi and her lover, the police had made several other associates accused. In this case, when Sonam got bail from the lower court, the Meghalaya government decided to challenge this decision in the Supreme Court. The country’s Solicitor General Tushar Mehta, appearing on behalf of the state government, made very strong arguments in the court.
Why was Sonam Raghuvanshi’s bail cancelled?
On behalf of the Meghalaya government, the Solicitor General told the court that the bail granted to accused Sonam Raghuvanshi is not legally valid. He clarified in the court that there was a small human error in typing the number of only one legal section in the documents related to the arrest. The state government said that it is not appropriate to grant bail to an accused of a serious crime on the basis of such a minor technical error. Along with this, the government also expressed the fear that if the accused stays outside, she may tamper with the evidence or may even abscond.
The court had given two tough options
During the last hearing of the case, the stance of the Supreme Court appeared very strict. At that time the bench had directly questioned Sonam Raghuvanshi’s lawyer and put two clear options before him. The court had asked whether Sonam would voluntarily surrender without any delay or whether the Supreme Court should issue a legal order to cancel her bail. After this, in the next hearing, the court finally gave its verdict and canceled the bail with immediate effect and set the deadline for surrender within three weeks.
The defense presented its arguments
During the hearing, Sonam’s lawyer put forward several points before the court to maintain the bail. He said that a total of 94 witnesses have been produced in this entire case, but till now the statements of only four people have been recorded. He also argued that the investigating agency has submitted the supplementary charge sheet and is strictly following all the stringent conditions with which Sonam was released. Apart from this, the defense side said that there is no possibility of the accused escaping.
Debate broke out regarding arrest and surrender
During the hearing of the case, Sonam’s lawyer gave another argument and said that Sonam had not herself surrendered before the police, rather she was duly arrested from Ghazipur district of Uttar Pradesh. However, the Meghalaya government strongly opposed this argument. The Solicitor General, citing the records and pages of the charge sheet in the court, said that it is clearly recorded in the papers that the accused had surrendered. He reiterated that the accused cannot be allowed to stay out of jail due to a technical error.
Sonam declared herself completely innocent
In her reply filed in the Supreme Court, Sonam Raghuvanshi called the entire matter false. He claimed that he had been forcibly implicated in this conspiracy and that he was completely innocent. He said that the entire case of the police and the prosecution is revolving around evidence based only on circumstances. He said that without concrete evidence, no one can be considered guilty and kept in jail for a long time on the basis of mere suspicion and allegations.
Further legal battle will continue in the trial court
This mysterious murder that took place during the honeymoon has been a matter of people’s fascination and debate since its initial days. Now after this new decision of the Supreme Court, Sonam will have to appear before the court within 21 days and go to jail again. At present, the main hearing of this entire case is going on in the concerned trial court. There the prosecution is continuously presenting its witnesses before the court. Legal experts believe that the final result of this much discussed case will be known only after the investigation of all the evidence and witnesses is completed.
