Supreme Court’s big comment – “Lathi charge cannot happen just because of agitation”, the right to peaceful protest is completely protected.

The Supreme Court made an important comment on Monday during the hearing of cases related to student protests, saying that Peaceful and lawful protest is a right fully protected by the Constitution. The court made it clear that the police cannot resort to lathi charge merely because of any movement.

A bench headed by the Chief Justice was hearing several cases related to the student agitation that took place on July 20. The petitions have alleged that tear gas shells were fired and lathicharge was done on the protesting students during the Parliament march. The petitioners have demanded an independent investigation into the entire matter, preservation of CCTV footage and other electronic evidence and compensation to the injured protesters.

During the hearing the Supreme Court said that “As long as the protest is peaceful, there cannot be lathi charge merely because there is an agitation. The right to peaceful protest is fully protected under the Constitution.”

The Supreme Court has also agreed to hear another petition, in which it has been alleged that some policemen were also assaulted during the demonstration.

It is noteworthy that on July 20, students in Delhi ‘Let’s go to Parliament’ There were clashes between police and protesters during the march. The protesters alleged that the police used force to disperse the crowd, while the police had described their actions as necessary to maintain law and order.

After this incident, protests intensified across the country. Many opposition parties also supported the students’ movement and demonstrated against the government in the Parliament and the then Education Minister Dharmendra Pradhan Raised demand for resignation.

Leader of Opposition in Lok Sabha Rahul Gandhi had also alleged that excessive force was used against the protesters. Although, Delhi Police has denied allegations of using pellet guns during the protests.while other allegations have drawn varying responses from relevant security agencies.

Meanwhile, Cockroach Janata Party (CJP) The 36-day movement led by MLA ended on Saturday. Following the agitation, the government accepted some key demands of the protesters and Education Minister Dharmendra Pradhan resigned from his post.

This comment of the Supreme Court is being considered important in future cases regarding the right to peaceful protests and the limits of police action. The court indicated that along with maintaining law and order, it is equally important to protect the constitutional rights of the citizens.
