According to the new rules, Telecommunications Companies are required to share information on numbers suspected of engaging in spam activities, and when multiple numbers associated with the same sender are flagged, further investigation is allowed. The framework sets requirements for automated calls, imposes termination charges for certain A2P calls, provides consumers with an opportunity to appeal, and imposes new restrictions on call-management applications.

Telecom companies will use AI-based methods to identify numbers that are highly likely to engage in spam activities and share information about them with other providers, TRAI said. This new process allows companies to take more stringent action when spam concerns arise from multiple numbers belonging to the same sender.

If companies flag five or more such numbers within 10 days, they can initiate re-KYC verification and physical verification of the sender. Further action may include blocking outgoing services, while repeated violations may result in connection termination.

TRAI defines Application-to-Person (A2P) calls as calls that are made through an application, software system or automated platform, without a person directly dialing the number. This definition includes auto-dialed calls, robocalls, pre-recorded messages and calls made using artificial or recorded voices.

Businesses and other organizations using the A2P calling system must inform their telecom providers about the service and the numbers used for these calls. If they do not report A2P calls, TRAI will treat them as unauthorized commercial communications.

What can happen under the new rules?

A termination charge of up to 5 paise per minute has also been introduced for A2P calls as per the new rules. TRI will exempt calls made from the numbering series prescribed for commercial communication, as well as calls specifically approved by the Authority.

For consumers, this new framework provides a mechanism to appeal against actions taken under anti-spam rules. TRAI has also taken additional security measures to prevent misuse of commercial headers and content templates. Call-management apps are bound to follow restrictions when handling calls from a certain numbering series. They cannot completely block, filter, or label incoming calls from the 140xx, 1600xx, or 1601xx series as spam.
