Justice Shekhar B. A bench of Justice Saraf and Justice Awadhesh Kumar Chaudhary clarified on Wednesday that the petitioner could not present any concrete document before the court in support of Rahul Gandhi's allegation of being a British citizen. In the writ petition filed by Ashok Pandey and another, a demand was made to issue a quo warranto writ challenging the right of Rahul Gandhi alias Raul Vinci to hold the post as Lok Sabha member from Rae Bareli. It was claimed in the petition that Rahul Gandhi is not an Indian citizen but a British citizen.

The court was told during the hearing that petitions had already been filed by the petitioners on the same issue in 2015 and 2019. Rejecting the 2015 petition, the coordination bench of the High Court had said that for redressal of the citizenship related complaint, one will have to approach the Central Government under Section 9(2) of the Citizenship Act, 1955. In 2019 also, freedom to represent before the Central Government was given in the petition filed on the same issue.

In the present petition, the petitioner alleged that Rahul Gandhi had declared himself a British citizen in the year 2003 in a UK registered company, Backops Limited, by declaring himself a director and major shareholder. During the hearing in this case, when the court asked about the basis, the petitioner could not present the records of the company or the Registrar of Companies of Britain or any document related to declaring British citizenship.

The court said that the alleged letter from Cambridge University, which purported to confirm the study of a person named Raoul Vinci, does not prove the allegations. After this the petitioner sought permission to withdraw the petition, which the court accepted and rejected as withdrawn.
