The student accused of forcing a minor student to wear burqa and convert to religion got anticipatory bail from Allahabad High Court.

Allahabad: The High Court granted anticipatory bail to a school student who is accused of allegedly brainwashing a minor student and pressurizing him to wear burqa and convert to Islam. While giving relief to the accused student Malyshka alias Malyshka Fatma, the bench of Justice Avnish Saxena said that apart from the statement of the victim, there is no other concrete evidence on record which could prima facie establish the involvement of the accused.

A case was registered against the accused under Sections 3 and 5(1) of the Uttar Pradesh Prohibition of Unlawful Religious Conversion Act. The FIR was lodged by the victim’s brother. It was alleged that the accused brainwashed his minor sister with the aim of converting her. It was also said that on December 20, 2025, she was forcibly made to wear burqa and was continuously pressurized to change her religion.

Opposing the anticipatory bail, the state government said that it is clear from the statement of the victim that she was being pressurized to convert to religion. Regarding the delay in registering the FIR, it was argued that the victim was under the influence of the accused, hence it took time to get the information.

On behalf of the accused, it was said that she was already studying in the same school as the victim and there is no complaint against her for pressurizing any other student for religious conversion. The court was also told that the main allegations in the case are against co-accused Alina, to whom the coordination bench of the High Court has already granted anticipatory bail.

The bench observed that the accused has no criminal history and apart from the statement of the victim, there is no other independent evidence available against him. The court also acknowledged that there is little possibility of the accused absconding and has assured cooperation in the investigation and trial. In view of these circumstances, the High Court granted anticipatory bail to the accused student.
