Amidst the ongoing debate in the country regarding Uniform Civil Code (UCC), a very big and revolutionary news is coming out from Madhya Pradesh. Many revolutionary recommendations have been made in the draft of the UCC Committee constituted by the Madhya Pradesh government regarding women’s rights, legal status of children and live-in relationships. Under this new legal draft, many stringent and modern provisions have been added to bring gender equality in the society and eliminate conservative traditions, which will change the entire picture of family laws of the state in the coming times.
Now, like husbands, wives will also have the legal right to divorce unilaterally.
The biggest and most important recommendation of this draft is related to the empowerment of women. Till now many personal laws propose to eliminate the privileges that men enjoyed in the case of divorce. According to the new rules, now the wife will also be able to file an application for unilateral divorce (Divorce Rights for Women) as legally as her husband. Additionally, it has been recommended to completely ban polygamy after marriage and implement mandatory marriage registration for all religions.
The word ‘illegitimate child’ or ‘illegitimate’ will be abolished forever, children will get full rights.
Taking steps towards social reforms, a historic humanitarian decision has been taken in the UCC draft regarding the rights of children. From now on, there are preparations to completely ban the use of derogatory words like ‘illegal’ or ‘illegitimate child’ for any child. Whether the child is born out of wedlock, live-in relationship or in any other circumstances, every child will have equal legal status in the eyes of the law and full rights in his/her parents’ property. In this UCC draft of Madhya Pradesh, strict provisions have also been made to regulate the modern lifestyle i.e. Live-in Relationship Rules. Now any couple in the state will have to compulsorily register with the local administration or nodal authority to live in a live-in relationship. If a couple is found living in a live-in relationship without registration, then a provision of punitive action and even jail term is proposed against them. Along with this, if there is any dispute during live-in, the female partner has also been given the right to claim maintenance.
