Prayagraj. Many cases of SC/ST Act are going on across the country. However, most of these are either found to be fake or the verdict on them has not yet been received from the courts. Because of this, questions are also being raised on SC/ST law. Now Allahabad High Court has given an important decision on the imposition of sections of SC/ST Act. Allahabad High Court has said that just because a person belongs to SC or ST, the sections do not apply to others. The Allahabad High Court has said that an offense under the SC/ST Act will be committed only when the accused has intentionally insulted on account of caste.
While hearing the case related to land deal in Ghaziabad, Justice Santosh Rai of Allahabad High Court canceled the court case going on against the accused Raju Qureshi alias Umardraj under the sections of SC/ST Act. In the year 2025, sections of SC/ST Act along with forgery, fraud and other sections were imposed on Raju in Loni police station of Ghaziabad. Raju Qureshi was accused of taking Rs 2.41 lakh advance in a land deal in Banthala village and committing fraud by not signing the deed. The special SC/ST court of Ghaziabad had issued summons to Raju Qureshi. Raju had filed a petition against this summons in Allahabad High Court.
In the petition, an appeal was made to cancel the case. Raju Qureshi's lawyer argued in the Allahabad High Court that the dispute regarding the land deal is civil. There is no allegation against his client for making casteist remarks in public. After the hearing, the Allahabad High Court said that unless there is an intentional intention to humiliate the victim because of his caste in the dispute and the incident does not happen in public, then sections of the SC/ST Act cannot be invoked. The court said that there is no evidence in the case diary that the accused said caste related words or insulted the victim publicly. The High Court termed giving a criminal turn to a civil dispute as an abuse of the legal process. The court said that Raju cannot be prosecuted under the SC/ST Act. The fraud case will continue against him.
