Supreme Court bans anticipatory bail of Pawan Kheda

Bureau Prayagraj- Congress leader Pawan Kheda has received a big blow from the Supreme Court. The Supreme Court has stayed the decision of anticipatory bail granted to Pawan Kheda from the Telangana High Court. This case is related to an FIR registered by Assam Police. This FIR was lodged by Rinki Bhuiyan Sarma, wife of Assam CM Himanta Biswa Sarma. On April 5, Pawan Kheda had accused Rinki Bhuiyan Sarma of holding passports of three different countries.

Justice J.K. Maheshwari and Justice A.S. Chandurkar’s bench has issued notice to Pawan Kheda and others and sought their reply. The next hearing of the case will be held after three weeks. The Supreme Court passed this interim order while issuing notice on the petition filed by the Assam government against the order of the Telangana High Court. Appearing on behalf of the Assam government, Solicitor General of India Tushar Mehta argued that there was no mention in Pawan Kheda’s petition as to how this jurisdiction is formed in Telangana.

Tushar Mehta also said that the High Court ignored the fact that one of these crimes carries a maximum prison sentence of 10 years. The Supreme Court said that in the note presented by Pawan Kheda during the hearing, it was stated that his wife lives in Hyderabad. But the Solicitor General argued against this that his wife’s Aadhaar card shows her as a resident of Delhi. The Solicitor General said that if this is so, then any person can buy property anywhere in the country and ask for anticipatory security from the place of his choice. He said this is ‘forum-shopping’.

He further said that the Supreme Court in its judgment in the ‘Priya Indoriya’ case had condemned such actions. The Solicitor General said that this is a complete abuse of process. He has not explained why he cannot go to Assam. The Solicitor General said that in the petition he has also not stated that his wife has any property in Hyderabad. At the same time, the Supreme Court said that we are surprised by the order of Telangana High Court. The Supreme Court said that Pawan Kheda has filed an application to extend the period of anticipatory bail.

On April 10, the Telangana High Court had granted one week’s transit anticipatory bail to Pawan Kheda with certain conditions. The case against Pawan Kheda is related to the FIR lodged at Guwahati Crime Branch Police Station. This FIR was registered on the basis of the allegations made in the press conference of Pawan Kheda on April 5. Pawan Kheda had claimed in the press conference that Riniki Bhuiyan Sarma, wife of CM Himanta Biswa Sarma, has multiple passports. He also has property abroad. CM Himanta has not given information about these facts in the election affidavit.
