At least the Aam Aadmi Party, making this claim, has requested the Rajya Sabha Chairman in writing to cancel the membership of all these seven members. It has said that this is what the experts of the Constitution say and the same is written in the 10th Schedule of the Constitution.
Senior AAP leader Sanjay Singh held a press conference on this matter on Sunday. In this he said, ‘Many constitutional experts, senior advocates of the country and constitutional experts Kapil Sibal and PDT Acharya have made it clear that the membership of the seven people who decided to break AAP and merge with BJP will be terminated. This is very clear.
Sanjay Singh said that after taking the opinion of constitutional experts like Kapil Sibal, a petition has been sent to the Chairman of Rajya Sabha and the Vice President of the country in which it has been requested to cancel the membership of these seven members as per the 10th Schedule of the Constitution. He said that he has demanded from the Chairman that he should hear it as soon as possible and give a fair decision from his side. It is also clearly written in the 10th Schedule of the Constitution that the Constitution of India does not allow any such sabotage.
Former Rajya Sabha deputy leader of AAP Raghav Chadha announced in a press conference on Friday that 7 out of 10 Rajya Sabha MPs of the party are leaving the party and joining BJP. He claimed that this number is more than two-thirds, so they can avoid the anti-defection law. Apart from Raghav Chadha, the rebel MPs include Ashok Mittal, Sandeep Pathak, Rajinder Gupta, Vikramjit Singh Sahni, Harbhajan Singh and Swati Maliwal. Of these, Raghav Chadha, Ashok Mittal and Sandeep Pathak joined BJP on Friday itself. Swati Maliwal confirmed joining BJP on Saturday. After the rebellion of these seven AAP MPs, AAP now has only 3 MPs left in the Rajya Sabha – Sanjay Singh, ND Gupta and Balveer Singh Seechewal.
On the rebellion of these seven MPs, senior AAP leader and Rajya Sabha MP Sanjay Singh had already said, ‘This is illegal, wrong, unconstitutional and against parliamentary rules. We will demand termination of their entire membership.’ Sanjay Singh has said that Punjab Chief Minister Bhagwant Mann is seeking an appointment with President Draupadi Murmu and he will demand recall of the 6 rebel MPs elected from Punjab. However, there is no such provision in the Constitution. Senior lawyer and constitutional expert Kapil Sibal told HT that no one can do the merger on its own unless the party itself first takes the decision to merge.
It is necessary to pass the resolution at the party level. Former Lok Sabha Secretary General PDT Acharya told HT that these 7 MPs cannot escape disqualification. However, on the right to recall or remove MPs, former Punjab Advocate General Ashok Aggarwal clarified that the ‘right to recall’ i.e. the right to remove an MP by the voter is nowhere in the Constitution.
