CAT gives a blow to Rekha Gupta government and bans transfer of Delhi DGHS, next hearing on May 29
Delhi DGHS chief Dr Vatsala Aggarwal, according to an office order issued by the Department of Health and Family Welfare, Delhi on May 21, 2026, was placed on “awaiting transfer” till further orders, which has been stayed by the Central Administrative Tribunal. Dr. Vatsala Aggarwal was put in the awaiting posting category without being assigned any new post. Nearly nine months after he was appointed, the order was passed by the Delhi government.
Dr. Vatsala Aggarwal had challenged the order issued by the Health and Family Welfare Department, Delhi, in which she was placed in the awaiting posting category. Was inserted.
Dr Aggarwal called the “awaiting transfer” order “punitive” and “arbitrary”. He further said that this action was related to a recent vigilance inspection conducted in the health department. The Central Administrative Tribunal first found that the order stated that Dr. Aggarwal may suffer irreparable harm. Therefore, the Central Administrative Tribunal has stayed the implementation of the transfer order till the next hearing on May 29, 2026. The tribunal has also sought a reply from the Delhi government in this matter.
Dr. Vatsala Aggarwal’s lawyer said that during his more than 30 years of service, no disciplinary action has ever been taken against him. He cooperated fully with the vigilance authorities, and whatever data and records were sought were shared.
The Central Administrative Tribunal also reminded the Supreme Court of its observations that transfer cannot be used as a punishment.
Raising another important issue, her lawyer said that Dr Aggarwal was overseeing the Delhi Medical Council elections to be held on May 31, and her sudden removal was a decision taken without thinking and arbitrariness. At the same time, it was also argued that removing him from his post without giving him any concrete post was a violation of the transfer policy of Delhi Health Service.
