Senior advocate Abhishek Manu Singhvi told a bench of Justice PK Mishra and Justice Atul S. Referring to the matter before Chandurkar’s bench, he described it as a matter deserving urgent hearing and sought urgent hearing or interim order. Taking cognizance of their arguments, the court has listed them for hearing on Friday. Singhvi argued that the returning officer rejected the nomination on the ground that Natarajan had not informed about the pending criminal case, whereas in fact only a summons had been issued and cognizance had not yet been taken in the case.
He said that even cognizance was not taken, yet the nomination was rejected. The petition alleges that the decision of the Returning Officer is illegal, arbitrary and biased. Also, a demand has been made to immediately cancel the order rejecting the nomination. The Supreme Court agreed to hear his plea on Friday, but added that the real legal remedy is to file an election petition after the completion of the election process.
