Delhi CPA corruption case: Questions raised on doctors, specifications and vendor selection of 19 departments on ACB radar

New Delhi: Central Procurement Agency of Delhi Government (The investigation into the alleged corruption case in CPA has now become more extensive. The investigation of the Anti Corruption Branch (ACB) is no longer limited to the procurement process only, but has reached the technical level. According to the information, now the role of those doctors and technical experts, who were part of the committees preparing technical specifications for various medical devices, has also come under the ambit of investigation. The investigating agencies are trying to find out whether there were any irregularities or biases in the technical standards that were fixed before the purchase of the equipment. For this, the role, documents and decision process of the members of the concerned committees are being examined.

According to sources, now doctors associated with about 19 different departments of the health department have come under the purview of this process. These include experts from many major departments including anesthesia, biochemistry, pathology, gynecology, radiology, gastroenterology and cardiology. According to the information, the responsibility of these doctors was to prepare the technical specifications of medical equipment and necessary materials. Now the investigating agencies are seeing whether there was any irregularity or bias in the process of deciding the specifications.

“Specification Committee” is an early and extremely important stage in any government procurement process. As per the General Financial Rules (GFR) 2017, Procurement Manual of the Finance Ministry, GeM Guidelines and Central Vigilance Commission (CVC) guidelines, this committee decides what will be the technical standards for a procurement. The main objective of this committee is to ensure that the procurement process is fair, transparent and promotes competition. That is, such standards should be set in which more and more eligible companies can participate in the tender process. According to the rules, the specifications should not be such that they benefit any particular company, brand or vendor. For this reason, the responsibility of the committee is limited only to assessing the need and clearly determining the technical requirements.

Why did the specification committee come under scrutiny??

Now the Specifications Committee has also come under the scanner in the alleged corruption case related to the Central Procurement Agency (CPA) of the Delhi government. Sources associated with the investigation claim that in some cases the technical specifications were prepared in such a way that competition was limited and some selected vendors benefited. It is alleged that some vendors had already received information about the technical requirements, based on which they prepared their products and documents accordingly. According to sources, the investigating agencies are also investigating whether there was any kind of collusion in the process of deciding the specifications. It is also being claimed that in some cases, contacts with vendors involved in the role of doctors and specialists are being investigated. According to the allegations, some vendors were given advance information about the specifications or technical standards were prepared accordingly, so that competition for other companies was limited. The Anti Corruption Branch (ACB) is now also interrogating the vendors concerned so that the links of the entire network can be connected.

First of all the specification committee prepares the technical standards. Its job is to decide what type of goods or equipment is to be purchased and what will be its technical requirements. GeM Bid Committee then publishes the tender and proceeds with the procurement process online or on the designated platform. The Technical Evaluation Committee then examines the technical merit of the bids submitted by the companies or vendors and ensures whether they meet the set standards or not. The Price Bid Committee then evaluates the financial proposals and decides which vendor’s bid is the most economically viable.

Government Procurement Rules Various provisions of the General Financial Rules (GFR) 2017, namely Sections 144, 149, 162 and 173 to 177, mandate transparency, competition and accountability in public procurement. The purpose of these rules is to ensure that all eligible companies get a level playing field and there is no discrimination in any procurement process. Along with this, the guidelines of the Central Vigilance Commission (CVC) also make it clear that if restrictive or limiting technical standards are prepared keeping in mind a single vendor or company, then it can be considered as a serious irregularity. Based on these provisions, the focus of the investigating agencies is no longer limited to the purchase orders only, but also to the stage where the technical specifications were prepared.
