Adani Case Update: US judge refuses to immediately dismiss Adani case, seeks clarification from DOJ

Adani Case Update: Business Desk: A major development has come to light in the American criminal case related to Gautam Adani. US District Judge Nicholas Garaufis of Brooklyn refused to immediately dismiss the case against Adani. The court has directed the US Justice Department (DOJ) to clarify by July 13 on what grounds it took the decision to withdraw the case.

The judge said that the government’s notice is only a brief and concluding statement. The court cannot reach any conclusion on this basis. Unless the government gives detailed reasons, no decision will be taken to end the case.

Adani Case Update: What is the whole matter?

In the year 2024, Gautam Adani was accused of committing securities fraud and wire fraud related to an alleged bribery scheme for the approval of solar energy projects in India. Besides, it was also accused of misleading American investors regarding the company’s anti-corruption practices. However, Adani Group has rejected all the allegations from the beginning.

On May 18, US government lawyers announced that they would not prosecute the case further. After this, Adani’s lawyers demanded the court to formally dismiss the case.

Adani Case Update: What argument did the lawyers give?

Adani’s lawyer Robert Giuffra said in the court that this matter is outside the jurisdiction of American law. He claimed that about 500 pages of documents were handed over to the DOJ, in which the legal and factual weaknesses of the case were pointed out. According to him, considering these weaknesses, the government decided not to pursue the case further.

SEC and other agreements also under discussion

Under the agreement with SEC, Gautam Adani will pay $6 million and Sagar Adani will pay $12 million in civil charges related to this case. Meanwhile, in a separate case, Adani Enterprises has agreed to pay $275 million to the US Treasury Department to resolve the dispute related to alleged violation of US sanctions imposed on Iran.

Adani Case Update: What will happen next?

Legal experts say that unless the judge formally dismisses the case, the charges against Adani will remain legally pending. At present, the court has given DOJ time till July 13 to file a detailed reply. Only after this will it be decided whether the matter will end completely or not.
