FSSAI slaps Swiggy Instamart; 9 Notices on complaints of expired and spoiled food

The Food Safety and Standards Authority of India (FSSAI ) has issued nine notices to ‘quick commerce’ platform ‘Swiggy Instamart’. Food safety regulator FSSAI said on Saturday that the action was taken following complaints of spoiled and expired food being supplied through these platforms. The Food Safety and Standards Authority of India posted on social media platform X that the nine notices were issued to ‘Swiggy Instamart’ after receiving complaints of violation of regulations under the Food Safety and Standards Act, 2006.

Consumers had complained that ‘Swiggy Instamart’ was being supplied with expired, spoiled, contaminated and otherwise unsafe food products, the regulator noted. FSSAA has directed these platforms to submit a detailed explanation and compliance report. Failure to do so will result in appropriate legal action. ‘Swiggy Instamart’ is the ‘live-commerce’ division of online food delivery company ‘Swiggy’.
Giving details of the complaints, FSSAI said that a complaint was received regarding a baby food which was found to be in very poor and unsafe condition. It showed signs of contamination as well as improper storage and handling. Even after returning the item, it was allegedly sent back to the customer. The complaints also alleged that ‘Swiggy Instamart’ supplied spoiled eggs and milk, as well as spoiled packaged food.

Unsatisfactory response
According to FSSAI, during the investigation it was also found that in some cases the FSSAI license numbers were incorrect, invalid or non-existent. Moreover, it was also found that food businesses were listed under names different from those mentioned in their FSSAI registration. The regulator said that some complaints alleged that there was no satisfactory response, grievance redressal or corrective action even after the matter was escalated to a higher level. Meanwhile, a complaint stated that only refunds were offered without addressing food safety issues. According to FSSAI, this notice has raised serious concerns regarding registration of vendors, verification of compliance with regulations, monitoring of food quality, redressal of consumer grievances and adequacy of food safety systems.
