In the event of an expired driving license, the insurance company will not be obligated to pay compensation in a road accident. Hearing an important petition, the Supreme Court has clarified that if the driver does not have a valid or renewed driving license at the time of the accident, the entire responsibility for the claim lies with the vehicle owner and driver.
Impact of the Court’s Decision on Motor Insurance
People often do not renew their driving licenses immediately after they have expired and continue to drive recklessly on the roads. Following this Supreme Court stance, this negligence on the part of drivers can lead to significant financial losses. The court has clarified that, according to insurance terms, it is mandatory for the driver to have valid documents while driving. If the license has expired, compensation for third-party claims or damage to the vehicle during an accident cannot be sought from the insurance company. In such a situation, the vehicle owner will have to pay the compensation to the victim out of his own pocket.
Verdict in a 2009 Road Accident Case
This entire case relates to a road accident that occurred in 2009. In this incident, a two-wheeler was hit by a vehicle driven by a man named Om Prakash. The investigation revealed that the driver’s license had long expired at the time of the accident, but it had been renewed much later. Although the Punjab and Haryana High Court directed the insurance company to pay compensation, the Supreme Court overturned this order. The Supreme Court held that not having a valid license at the date of the accident was a direct violation of the insurance policy’s terms, and therefore, the insurance company was not liable for compensation.
Directives to Improve Driving Schools and Licensing Process
Given the seriousness of the matter, the Supreme Court has directed the Central and all state governments to make the driving license renewal and application process more transparent and simple. The court stated that the driving license test and application process should be made available in regional languages for easy understanding by the public. It also emphasized the need to improve the quality of driving schools across the country and keep their fees affordable to ensure strict adherence to road safety standards.

Following this Supreme Court decision, it has become extremely important for every driver to periodically check the validity of their driving license. The process of renewing the license should be initiated before it expires.
