The Supreme Court said that the High Court made a mistake by interfering in the order of the Tribunal. The Court clarified that the Tribunal can order eviction if necessary for maintenance and security. The court said that tribunals have been created under Section 7 of the Act and Section 8 gives them powers like civil courts. At the same time, Section 27 restricts the jurisdiction of the civil court. Therefore the Tribunal also has the power to take necessary steps to implement the purpose of the law.

The whole matter is of Lucknow, the capital of UP. Lucknow resident Ravi Kant Gupta had applied to the District Magistrate on June 5, 2022 to evict his son from the house. This house was his own purchased property. The matter came to light when Gupta's 81-year-old mother was forced to leave her home and live in an old age home. SDM ordered the son's eviction on 15 November 2022. The District Magistrate also upheld this on August 9, 2023 and directed the son and daughter-in-law to vacate the house.

After this the son and daughter-in-law challenged the order in Allahabad High Court. The High Court changed the decision of the lower court and said that the 2007 law does not give the elderly the right to evict children from their property. After this the orders were cancelled. After this, Ravi Kant Gupta filed a petition in the Supreme Court challenging the decision of the High Court. The Supreme Court has now changed the order of the High Court while giving its verdict. Also said that elderly parents can evict children from the property.
