Gurugram. Gurugram Police has arrested accused Kalyan Bainsla, who was absconding in the case of hitting female bike rider Siya with a car on Golf Course Road in Delhi NCR. The accused was arrested from Dausa district of Rajasthan. After this incident that took place on September 13, the victim Siya had accused the car driver of deliberately hitting the bike and trying to take her life.
At the same time, the accused says that he did not collide with him intentionally, but he collided with him during overtaking. During the investigation of the case, the police have also added section 109 (attempt to murder) of BNS after analyzing the video footage. Earlier, the police had registered a case under sections 281 and 125 of BNS on charges of careless driving.
Sia's allegation – an attempt was made to kill me
After the hit and run incident, Sia, while talking to a news channel, claimed that an attempt was made to kill her in broad daylight. He said that during the incident he was constantly afraid that the car might hit his bike.
According to Siya, the car driver was first signaling them to stop. When he did not stop the bike, the driver turned the car towards his bike and fled from the spot after hitting him. He says that he could have lost his life that day. Sia has demanded strict action against the accused.
Accused of trying to stop the bike
Siya was going on Golf Course Road with other riders on her bike. He alleges that the car riders were continuously signaling him to stop. Fearing some untoward incident, he increased the speed of the bike. According to Siya, the speed of the car reduced and the driver suddenly turned the car towards his bike. After this the car hit the bike. The driver fled from the spot after the accident. The matter came into discussion after the video of the incident was circulated on social media.
Section of attempt to murder added after video footage
Taking suo motu cognizance of the matter, Gurugram Police had registered a case at Sector-56 police station. In the initial investigation, action was taken under sections 281 and 125 of BNS on charges of careless driving. The police thoroughly analyzed the video footage related to the incident. According to police, in the footage the car was seen turning in the direction of Sia's bike. After this, Section 109 of BNS was also added in the case.
Three special teams searched for the accused
The accused Kalyan Bainsla was absconding since the incident that took place on September 13. Gurugram Police had formed three special teams to arrest him. After continuous search, the police team arrested the accused from Dausa, Rajasthan. After the arrest, the police is interrogating the accused regarding the incident. Video footage, Sia's statement, claims of the accused and other evidence are being included in the investigation.
The accused said – the collision was not intentional
During interrogation, accused Kalyan Bainsla has presented a different version of Sia's allegations. He claims that the bikers were traveling at high speed and the collision happened due to negligence while overtaking. The accused also claimed that the bikers were provoking him and he was trying to pacify them. He says that he did not hit the bike intentionally.
Sia had also accused him of being drunk
Sia had also alleged that the youth in the car were drunk. However, Kalyan Bainsla has rejected this claim. He says that the incident took place around seven in the morning and the statement that he was under the influence of alcohol is false.
Siya's question: If you accidentally collided with someone then why did you run away?
Sia has raised questions on this claim of the accused. He says that if the collision was accidental then why did the car driver run away from the spot instead of stopping at the spot after the accident. At the same time, Kalyan says that he feared that the bikers might assault him. For this reason he left the spot.
At present, after the arrest of the accused, the police is carrying forward the investigation of the case. On the basis of video footage and statements of both the parties, police are trying to find out the circumstances under which the collision took place and what was the intention of the accused.
