Bharat Bhushan Tiwari encounter case reaches Supreme Court after PIL filed in Patna High Court, demand for CBI investigation under the supervision of retired judge
Patna. Youth Bharat Bhushan Tiwari was killed in a police encounter in Shahpur police station area of Bhojpur district in Bihar, in which a Public Interest Litigation has been filed in the Patna High Court to conduct a fair investigation and take legal action against the guilty police officers involved. Advocate Mukesh Kumar has filed this petition demanding an independent investigation into the matter and bringing the officers responsible within the ambit of the law and interrogating them. Along with this, the advocate has appealed before the division bench of Chief Justice Meenakshi Madan Roy of the court for hearing of this case as soon as possible.

Why didn’t the police arrest him?
In the petition, Bharat Bhushan Tiwari has been accused that before this incident, a video of him allegedly waving weapons had gone viral on social media. The same petitioner has claimed that if the police had enough information then why was he not arrested? Also, no weapon was recovered from him and the very next day the young man died in an alleged police encounter, due to which serious questions are being raised on the entire incident.

Advocate Mukesh Kumar has claimed that prima facie this case appears to be a murder and it is necessary to conduct an impartial investigation. He also alleged that if a person has surrendered and still he is shot, then his accountability should be fixed. Not only this, an FIR should be registered against the police officers related to this matter. At the same time, police officials claim that Bharat Bhushan Tiwari had fired 10-12 rounds, after which the encounter had to be done while retaliating in self-defense. Bihar Chief Minister Samrat Chaudhary has announced that the government will conduct a judicial inquiry by a retired High Court judge to investigate the matter with complete transparency. At the same time, as part of initial administrative action, four policemen involved in the encounter have been suspended with immediate effect.

Demand for CBI investigation in Supreme Court
Supreme Court advocate Vishal Tiwari has also approached the country’s top court regarding this matter. In this petition filed in the Supreme Court, a demand has been made to get the entire matter investigated by the Central Bureau of Investigation or to constitute an expert committee under the chairmanship of a retired judge of the Supreme Court. However, the Vacation Bench of the Supreme Court, in view of the urgency of the matter, has refused to hear it immediately and has directed the petitioner to write and mention it before the Registrar.
