Alleged liquor scam case: Hearing postponed in Delhi High Court, next date fixed on Monday

Delhi’s alleged liquor scam case heard in court on Wednesdayin which the proceedings proceeded amid a boycott of the court by Justice Swarnakanta Sharma on behalf of Arvind Kejriwal, Manish Sisodia and Durgesh Pathak. During the hearing, Justice Swarnkanta Sharma said that due to non-availability of records related to the trial court and non-filing of replies by some defendants, detailed hearing of the case was not possible. For this reason the court adjourned the hearing till Monday. Giving another opportunity to all concerned parties to file replies, the court directed that the next hearing will be held on Monday at 2:30 pm.

Solicitor General Tushar Mehta, ASG SV Raju and ASG DP Singh were present in the court on Wednesday during the hearing of Delhi’s alleged liquor scam case. The bench of Justice Swarn Kanta Sharma clarified during the hearing that it has not yet received the complete record of the trial court. On this, the court directed that the entire record of the trial court should be presented immediately through a special messenger. The court also said that the hearing scheduled for Thursday had to be canceled due to non-availability of records. Additionally, the bench also noted that some of the respondents have not yet filed their replies, due to which the proceedings could not proceed further.

The bench of Justice Swarn Kanta Sharma said during the hearing that the defendants who have not filed their reply by Saturday will be given another opportunity. The court directed that this process be completed by Saturday and the next hearing will be held on Monday. The bench also said, “We will call for the complete records of the trial court and the hearing will begin on Monday.” The court reiterated that the proceedings are being delayed due to non-availability of records. Meanwhile, advocate Farrukh Khan, appearing for one of the defendants, told the court that he has filed an application to cancel the stay order. On this, Solicitor General Tushar Mehta said that he will file a reply on this.

New notice in ED case

Delhi High Court on Wednesday issued a new notice to Aam Aadmi Party national convenor Arvind Kejriwal. This notice has been issued on the petitions of ED, challenging the decision of the lower court acquitting him in two separate cases related to the excise policy case. ED has said in its petitions that despite the summons being issued, Arvind Kejriwal did not appear before the investigating agency, and on this basis the trial court’s order of acquittal has been termed wrong.

According to sources, Aam Aadmi Party’s Arvind Kejriwal, Manish Sisodia and Durgesh Pathak have announced boycott of Justice Sharma’s court. It has been alleged by these leaders that there are doubts regarding impartiality in the case, although these allegations have come out in the form of claims of the parties. It is being told that this stand has been adopted after the petition for recusal (separation from the case) was rejected. After this, it was also claimed that the lawyers would not appear in the court on behalf of the concerned parties, which they termed as a protest or “satyagraha” move.
