District Magistrate/Vice Chairman Rampur Development Authority issued order for demolition of illegal constructions of Mohammad Ali Johar Trust.
Rampur . District Magistrate/Vice Chairman Rampur Development Authority Ajay Kumar Dwivedi, after detailed hearing, examination of records and in-depth study of legal provisions in the case related to Mohammad Ali Jauhar Trust and Jauhar Ali University, Rampur, has passed an important order under Section 27 of the Uttar Pradesh Town Planning and Development Act, 1973 and has issued an order for demolition of 38 illegal constructions.
Based on the report of the Regional Sub Engineer, the authority registered a case and issued a notice on June 28, 2026. After this, on June 29, 2026, a notice was sent to the Secretary, Mohammad Ali Jauhar Trust and the Registrar, Jauhar Ali University and given an opportunity to present their side. The defendants jointly submitted their written reply on 08 July 2026.
After receiving the written reply, Rampur Development Authority, following the principles of natural justice, also provided an opportunity of personal hearing to the respondent. For this, the date of July 15, 2026 was fixed, in which the advocate and university officials appeared on behalf of the defendant and presented their side.
During the hearing, the facts presented, written reply of the defendant, records received from District Panchayat Rampur and all available documents were examined in detail. In this regard, in the information provided by the Additional Chief Officer, District Panchayat Rampur, it was clarified that out of the total 40 buildings located in this complex, the maps of only two buildings were duly approved by the then District Panchayat. Apart from this, no record of obtaining map approval or construction permission from the District Panchayat or any other competent authority was found available for any other building.
District Magistrate/Vice Chairman Rampur Development Authority has clarified in its order that as per Section 59 of the Uttar Pradesh Town Planning and Development Act, 1973 and other relevant legal provisions, if any area is later included in the limits of the Development Authority, then such constructions can be considered valid only if at the time of their construction, due map approval or construction permission has been obtained from the then competent authority. No such evidence could be presented by the defendant in respect of the remaining buildings.
The authority has also mentioned in its order that it was argued by the defendant that the concerned land was not earlier under the jurisdiction of Rampur Development Authority and the constructions were done earlier. Examining this argument, the authority said that even during that period, map approval from the competent authority was necessary for construction under the District Panchayat Act and applicable rules. The proof of this itself comes from the fact that the maps of two buildings of the complex were approved from the then District Panchayat, whereas no approval was presented for the remaining buildings.
In his order, he also mentioned the instructions passed by the Supreme Court against illegal constructions and said that strict and effective action is required in such cases. On the basis of available records, legal examination and evidence received from the District Panchayat, it was concluded that except the Medical College Building and the Academy Block, the remaining 38 buildings, whose total area is 82,309.80 square meters, were constructed without the approval or permission of the competent authority.
He also clarified that the land on which these constructions are situated and the purpose for which they are being used is not permissible as per the current land use. Therefore, regularization of these constructions is not possible and demolition is the only legal option as per legal provisions.
District Magistrate/Vice President RDA has also given instructions that the students studying in the university should not face any kind of inconvenience. For this, the Regional Higher Education Officer and District School Inspector will set up counseling camps in this campus and provide necessary guidance and proper assistance to the students so that their educational interests can be protected.
He has clarified that similar legal and effective action will continue in the future also against any illegal construction done in the district without an approved map or permission of the competent authority.
