Justice Swarna Kanta Sharma’s children Central government lawyer Arvind Kejriwal filed a new affidavit; made allegations

Arvind Kejriwal New Affidavit: Former Delhi Chief Minister Arvind Kejriwal has filed a fresh affidavit in the Delhi High Court, giving a new legal twist to the excise policy matter. In this affidavit, he has further strengthened his demand to remove Justice Swarn Kanta Sharma from the case. According to the Bar & Bench report, Kejriwal has raised the issue of possible conflict of interest by raising questions on judicial impartiality.

Furthermore, he claimed that the judge’s family ties and association with the government legal structure raise serious questions about the fair trial of the case. Kejriwal himself is an accused in this case and this step on his part is considered very important as a legal strategy.

What is Kejriwal’s new claim?

Arvind Kejriwal has alleged in his affidavit that the children of Justice Swarn Kanta Sharma are panel lawyers of the Central Government. He says that the work of assigning cases to these lawyers is done by Solicitor General of India Tushar Mehta, who is representing the Central Bureau of Investigation (CBI) in the same case. According to Kejriwal, this situation clearly indicates a conflict of interest as there appears to be an institutional link between the prosecution and the judge’s family. Calling it a direct and serious conflict, he has raised questions on judicial impartiality.

To strengthen his claims, Arvind Kejriwal has also cited documents obtained under the Right to Information (RTI). According to these documents, several government legal functions were allotted to the judge’s son between 2023 and 2025. Kejriwal says that such information should have come out at the beginning of the hearing itself. He alleged that the Solicitor General should have revealed this fact earlier and not let it come to light later through the media or social media. According to him, lack of transparency affects the credibility of the judicial process.

Questions were also raised on the hearing process

Kejriwal has objected not only to the conflict of interest but also to the process of hearing. He said that he was not given adequate opportunity to present his side. According to him, he had left around 3:45 pm after taking permission from the court and he did not expect the hearing to proceed beyond the scheduled time but the proceedings continued till after 7 pm and ended on the same day. Because of this he did not get a chance to prepare counter arguments effectively.
