Fed fake cheese to customers, have to bear the brunt of it: HC did not give relief to Udupi Swad restaurant

Mumbai Thane's restaurant Udupi Swad has not received any relief from the Bombay High Court at present. The Food and Drug Administration (FDA) had suspended the restaurant's license. It is alleged that banned analog cheese was being served to the customers here. The restaurant management had reached the High Court challenging this action.

A bench of Acting Chief Justice Ravindra Ghuge and Justice Gautam Ankhar refused to grant immediate relief on the restaurant's plea. During the hearing, the court made a strict comment and said that the way the establishment put the customers in trouble by serving such food, now it too will have to face action.

'Customers should know what they are being fed'

During the hearing, the court asked the restaurant management whether it was clearly stated in its menu that the paneer being given to the customers was not prepared from milk, but was analog paneer. The bench said that if a customer asks for paneer, he cannot be served something else by passing it off as paneer.

The court also questioned the restaurant's argument that the FDA should have provided an improvement notice before suspending the license. The bench said that customers have the right to know what is being served on their plates. The court also asked the affected customers to approach the consumer forum and demand compensation.

Restaurant said- will not use analog cheese in future

The restaurant assured the court that analog cheese would not be used in future. However, the court refused to grant immediate relief on the basis of this assurance. The Maharashtra government has banned the manufacture and sale of analog cheese for one year in view of violation of public health and food safety norms.

How is analog cheese different from real cheese?

In analog cheese, vegetable oil is used instead of milk fat. Starch, emulsifier and other substances can also be used in its preparation. It is cheaper than normal cheese and the amount of protein in it is also less.

According to the rules, there is a provision of serious punishment in case of death of a person due to unsafe food. In this, there is a provision of life imprisonment along with a fine of at least Rs 10 lakh.

Hearing will be held again on September 7

The FDA had issued an order to suspend the restaurant's license on August 11. The management filed a petition in the High Court against this decision. Now the court has directed the FDA to file its affidavit. The next hearing of the case will be on September 7.
