Taking an important and tough stand, the Supreme Court on Monday has clearly refused to impose any kind of ban on the protest march proposed by the Cockroach Janata Party i.e. CJP in the capital Delhi on September 5. The country's top court has said in clear words that it has full hope that all the parties taking part in the protests will behave in a completely peaceful manner and will conduct themselves within the ambit of the law. Along with this, the court also bluntly said that the main responsibility for smoothly maintaining law and order and security in the national capital will entirely rest with the concerned administrative and police agencies. Amidst the ever-increasing political and social turmoil in the country's capital Delhi, this decision of the Supreme Court is being considered very big, because on one hand it indicates the protection of democratic rights, while on the other hand it has also given a strong warning regarding maintaining security and peace. Know what is the whole matter and why the petition has been filed. While hearing the matter, a special bench of Chief Justice Surya Kant, Justice Joymalya Bagchi and Justice V. Mohana gave important instructions to the petitioner to present this petition before the High Power Inquiry Committee already constituted by the Supreme Court for an impartial investigation into the alleged violence and other irregularities that took place during the NEET examination. While issuing notice in this sensitive matter, the court has also ordered that this petition be listed along with other related pending petitions and now the next hearing of this case has been fixed on September 10. Meanwhile, it was argued on behalf of the petitioner that such large-scale demonstrations in very sensitive and strategically important areas of the national capital Delhi can have a huge impact on normal life as well as the security system, on which the court has advised all parties to exercise restraint. Big responsibility of law and order and security agencies: During the hearing, the court specially emphasized that it is also the responsibility of the protesters to avoid any kind of violence or disruption while protesting and to demonstrate completely peaceful conduct. Additionally, it is the direct and primary responsibility of all major law enforcement agencies of the country to determine on the ground what falls within the legal ambit and what activities need to be banned. The court has made it clear in its oral and written instructions that it is deeply expected from both the parties that they should fully respect the Constitution and laws of the country, maintain complete restraint in their daily behavior and events and stay away from any activity that may create even the slightest possibility of disturbing social harmony or law and order. Preparations for a march from India Gate to Police Headquarters on 5th September i.e. Teachers Day Cockroach Janata Party i.e. CJP has openly called for a big protest march in Delhi on the auspicious occasion of 5th September i.e. Teachers Day. The main allegation of the party is that all the promises made by the Central Government on July 25 to somehow end the 36-day long agitation against the alleged widespread irregularities in the examinations across the country, have not yet been fully fulfilled. According to the information given by CJP, their proposed march has been decided to start from the historic India Gate and reach Delhi Police Headquarters. However, amid this entire incident, a statement has already come out from the Delhi Police that they have not yet received any official prior request or application for any such procession, march or big event, due to which the police administration also seems to be fully alert and prepared at its level. Demand to control the march in security sensitive areas: In this entire matter, a petition was filed in the Supreme Court on behalf of a retired Delhi Police officer, Rajendra Singh, in which it was strongly demanded that in India Gate, Central Vista and all the surrounding areas, which are considered very sensitive from security and strategic point of view and of constitutional importance, permission should be given for gathering of people on a large scale, taking out a march or any kind of organized demonstration only when its organizers have already obtained all the necessary permissions as per the law. The petition also specifically demands that any major demonstration proposed in a high-security area like Lutyens' Delhi should either be controlled, postponed or its planned form should be suitably modified. The petitioner has also urged the court that this type of strict system should be strictly implemented till the completion and conclusion of the prestigious BRICS Summit proposed in the country on 12th to 13th September so that the image and security of the country at the international level is not affected. The petition also expresses serious concern that during the protests, no march, procession or vehicle rally should go beyond the prescribed and authorized limits and enter any sensitive or restricted area, and all legal permissions and regulatory regimes applicable in the concerned area should be strictly followed. Since this proposed march to be organized by CJP is to be held exactly on Teachers' Day i.e. 5th September, the importance of this political and social event has increased even more. According to media reports and available information, this march is also said to be attended by the families of those students who had allegedly lost their lives or committed suicide due to the stress of the events related to the cancellation of NEET exam this year and the subsequent re-examination. Apart from this, the families of the students, who allegedly faced police excesses and administrative strictness during the agitation during the month of July, are also preparing to take part in this march enthusiastically, due to which both political excitement and vigilance of security agencies in the capital Delhi remain at their highest level.
