Congress spokesperson Pawan Khera granted conditional anticipatory bail from Supreme Court, will have to register his presence on police call.
New Delhi, May 1. The Supreme Court has granted conditional anticipatory bail to Congress spokesperson Pawan Khera, who is in serious trouble due to his controversial statement regarding the passport related to Rinki Bhuyan, wife of Assam Chief Minister Himanta Biswa Sarma. During the hearing held a day earlier (Thursday), Justice J.K. Maheshwari and Justice A.S. Chandurkar’s bench had reserved its decision after hearing the arguments of both the sides.
The top court made it clear that the personal liberty of an individual, which is protected under Article 21 of the Constitution, cannot be easily jeopardized. The court has directed that Pawan Kheda be released on anticipatory bail in the event of his arrest in Crime Branch Police Station Case No. 04/2026.
The top court said that it is aware of the fact that allegations and counter-allegations have been made by both the parties (Kheda and Himanta Biswa Sarma’s wife), but no one’s freedom can be played with. The court also said in its order that the documents and facts mentioned while considering the bail have no bearing on the final decision of the case.
Actually, this case was registered against Kheda regarding the statement related to Rinki Bhuinya. Kheda had accused Rinki Bhuiyan Sarma of having multiple passports and properties abroad.

- The court also made it clear that the appellants would not be able to leave the country without the permission of the competent court.

- The court also said in its order that the documents and facts mentioned while considering the bail have no bearing on the final decision of the case.
- The trial court will proceed further as per law without being influenced by these observations.
- Relief was not received from the lower court
It is noteworthy that Pawan Kheda had earlier filed a petition for anticipatory bail in the lower court of Assam and also in the Guwahati High Court. Due to not getting relief from both the courts, he reached the Supreme Court. Earlier, the Telangana High Court had given him a week’s transit bail, on which the Supreme Court had put a stay on it and directed the Congress leader to approach the Gauhati High Court for anticipatory bail.
