New Delhi: The Tamil Nadu Assembly elections have yielded surprising results this time around. The TVK party—led by actor-turned-politician ‘Thalapathy’ Vijay—secured the highest number of seats, a feat being hailed as a major achievement in its own right. Notably, this was the party’s very first electoral contest. TVK won 108 seats, falling just 10 short of the “magic figure” required for a legislative majority.

With the current Assembly’s tenure set to conclude on May 10, the formation of a new government is imminent. According to legal experts, the process of constituting the new Assembly must be completed before the current term expires. The TVK—the party led by Vijay—is highly likely to attain the necessary majority. Furthermore, as the single largest party, it is expected that the Governor will extend the first invitation to form the government to them.

Congress to Support TVK

The Congress party has expressed its willingness to extend full support to TVK in forming the government in Tamil Nadu. In a press release issued on Wednesday, Girish Chodankar—the AICC in-charge for Tamil Nadu—stated that their support would be conditional upon TVK keeping “communal forces” (those that do not uphold the Indian Constitution) excluded from this alliance. Additionally, several other parties have indicated their readiness to join a TVK-led government; however, the respective parties have not yet made an official announcement to this effect.

Key Points Regarding Government Formation

According to Supreme Court advocate Krishnamurthy, it is mandatory to constitute a new government in Tamil Nadu by May 10. Speaking on the matter, he noted that the tenure of the current Tamil Nadu Assembly expires on May 10, and a new government must be in place by that date. To achieve this, the party seeking to form the government will be required to submit letters of support from the requisite number of MLAs to the Governor in order to demonstrate their legislative majority.

Regarding the process of government formation, senior journalist Kupendran observes that—even without the necessity of going through every procedural formality—there is a strong likelihood that Vijay will meet with the Governor to stake his claim to form the government, backed by letters of support from a majority of the MLAs.

He further pointed out that parties other than the DMK and AIADMK collectively hold more than 11 seats, and these parties could potentially extend their support to TVK. These include five MLAs from the Congress, two from the VCK, four from the Communist parties, and one from the DMDK.
