Prateek Bharda, a practicing CA, narrated an incident that happened on September 8. He explained that he had gone to a restaurant in Udaipur and his bill was ₹641.90. It added ₹32.10 as GST, comprising 2.5% CGST and 2.5% SGST. Before paying, Prateek first checked whether the restaurant paying composition tax could collect GST from customers.

GST can be checked like this

Prateek further said that he visited this website before paying the bill. He typed the GSTIN on the bill, clicked search, and when the status 'Regular Taxpayer' appeared, he made the payment immediately. However, not everyone does. While paying after meals at restaurants and dhabas, people often do not check whether the business is registered under the appropriate tax scheme or not. “Composition Taxpayer cannot charge you GST,” says Pratik.

Who has no right to collect GST?

As per the rules, restaurants registered as composition dealers pay tax at a fixed rate to the government. They do not have the right to collect GST from customers and cannot add GST to the bill separately. If they do, that money goes directly into the owner's pocket, not the government. That is, this 30-second check is mainly done to find out whether the restaurant is registered under the composition scheme or under the regular scheme.

Do this verification in 30 seconds

First go to the official GST portal, gst.gov.in, on your phone.
Go to the menu and select Search Taxpayer.
Now, enter the 15-digit GSTIN number printed on the restaurant bill and search by filling the captcha.
Next, check the status of the taxpayer type on the screen.
If it says composition, then they cannot charge you even one rupee of GST. Ask them to remove the GST from the bill immediately.
If it says Regular, then they are eligible to charge 5% or 18% GST as per rules.
If a composition restaurant is charging GST forcefully, you can file a complaint with GST council or consumer forum along with proof.
