Gyanesh Kumar: On a PIL raising questions on the functioning of Chief Election Commissioner Gyanesh Kumar Supreme Courthas agreed to hold a hearing next week. Election CommissionQuestions have been raised in the petition about whether two election commissioners were approved while taking the decision, and how the multi-member structure of the commission is actually working.
The case was mentioned on Tuesday Chief Justice Suryakant It was done before the bench headed by In this bench, Justice Joymalya Bagchi and Justice V. Mohana is also included. Senior advocate Vikas Singh mentioned this petition. The Chief Justice then said, “We will record it next week.”
Who filed the petition?
This petition (PIL) has been filed by Rakesh Kumar Singh from Patna. It has been claimed in the petition that the powers of the Election Commission are not merely individual powers of the Chief Election Commissioner but are supposed to be exercised collectively by the Commission.

The petition claims that Election Commissioners Sukhbir Singh Sandhu and Vivek Joshi raised objections at least 14 times on various decisions between October 2025 and August 2026. In particular, it has been said in the petition that there are objections to some decisions related to Special Intensive Revision or SIR process of voter list.
Mention of Form-6, SIR procedure in the petition
The petition also mentions issues like changes in Form-6, use of ERONet/ECINet database related to electoral voter list, allocation of IT work and appeals in West Bengal.
The petitioners have requested to summon agendas, minutes, file notings, approval documents, IT system related records and other primary records of the commission meetings before the court.
Meanwhile, the allegations in this case are the claims made in the present petition. It has not been concluded in the petition that they have been conclusively proved. The Election Commission has earlier said that differences of opinion between two commissioners are a normal part of discussions in any institution and clarified that the Commission's orders are in accordance with legal process. Now the Supreme Court is paying attention to what position it will take on this petition next week.
