New Delhi:The Supreme Court has taken a strong stand on the unilateral action of the Noida administration in the case related to the protests organized at Jantar Mantar. The bench appeared extremely angry when notice was issued to a second year student despite clear orders of the apex court. Considering this entire incident as a case of direct contempt, the court strongly reprimanded the Executive Magistrate of Noida and summoned an explanation from the District Magistrate (DM). The Supreme Court has made it clear that it will seek answers from the District Magistrate of Noida in this matter and fix accountability.
Supreme Court enraged by action against students
During the hearing, this serious issue was raised before the bench headed by Chief Justice Surya Kant. The petitioner’s lawyer said that earlier judicial orders had prohibited punitive action against the students.
Despite this, the local magistrate ignored the orders and served an official notice to the student, to which the court took strong objection.
‘Administration should stop experiments on students’
During the hearing, the lawyer told the court that by adopting such a stance at the administrative level, an attempt is being made to create an atmosphere of fear among the youth and students of the country, which is a kind of administrative experiment. When the bench asked about the withdrawal of the notice, the lawyer said that information about its withdrawal was received from media reports only, but no official document has been produced.
CJI Surya Kant raised the question in a strong tone that when the court had issued clear instructions, then how could any magistrate have such courage. The bench considered this attitude extremely objectionable and said that such ignoring of judicial orders cannot be tolerated at all.
Instructions for presenting evidence
Responding to this, the CJI reiterated that if any illegal action has been taken at the administrative level, a show cause notice will be issued to the concerned authorities. Justice Bagchi, who was part of the bench, directed the petitioner’s counsel to bring the notice and all factual documents and evidence related to this action on official record. The Supreme Court has made it clear that it will seek answers from the District Magistrate of Noida in this matter and fix accountability.
