Vivek Tiwari Murder Case: The final verdict of the court has come in the sensational Vivek Tiwari murder case that took place about 8 years ago in Lucknow, the capital of Uttar Pradesh. The District Court of Lucknow has convicted the main accused and former constable Prashant Chaudhary of culpable homicide and sentenced him to ten years of rigorous imprisonment. Another constable Sandeep Kumar, who was a co-accused in the case, has been completely acquitted of all charges. With this decision, one of the most discussed and controversial cases of the capital has been judicially resolved.
Court decision and legal provisions
The court has found Prashant Chaudhary guilty under section 304 part two of the Indian Penal Code. Under this legal provision, such an act comes in which the direct intention to take life is not proved but there is definitely knowledge that by that action someone's life can be lost. On this basis, the court decided the punishment period after considering the arguments and evidence of both the parties. Prashant Chaudhary has already spent about 8 years in jail. The court clarified that the bullet fired by the accused had taken the life of an innocent civilian.
Relief to second constable Sandeep Kumar
In this case, a case was registered against two constables of Uttar Pradesh Police, Prashant Chaudhary and Sandeep Kumar. Both of them were accused of being present at the spot at the time of the incident and taking part in the action. After a long hearing, the court examined the evidence regarding the role of Sandeep Kumar. The court found that Sandeep Kumar had no direct role in the firing. Due to this, Sandeep Kumar was acquitted of all charges. With the acquittal, all the legal processes going on against Sandeep have ended.
what happened that night
This dreadful incident happened late night on 28 September 2018. Area Manager of Apple Company, Vivek Tiwari was going to drop his colleague Sana Khan home. Both were passing through Gomti Nagar extension area in their car. Meanwhile, two policemen patrolling the area on motorcycles considered his vehicle suspicious and signaled him to stop. When the car did not stop, the policemen tried to stop it and during this, Prashant Choudhary shot directly at the glass of the car with his service pistol. The bullet hit Vivek Tiwari's face and the car went ahead and collided with the divider.
Vivek died in the hospital
After being shot, Vivek Tiwari was immediately taken to Lohia Hospital in critical condition. Doctors tried their best to save him but due to excessive bleeding and deep bullet wounds, his life could not be saved. This incident had shocked the entire city. Deceased's co-worker Sana Khan was an eyewitness to this entire incident. He later presented the entire truth to the police and media as to how the constable took the deadly step without facing any major danger.
SIT investigation and long court battle
There was huge public anger after the incident came to light. Questions were raised on the government and police administration, after which both the constables were dismissed with immediate effect and arrested. The government had constituted a Special Investigation Team (SIT) for an impartial investigation of the case. The SIT investigated the spot and with the help of forensic experts connected the links of the entire incident. After the charge sheet was filed, statements of witnesses were recorded in the court. After this long court battle that lasted for about 8 years, the victim's family got justice.
