Jailed MP Engineer Rashid knocked on the door of Delhi HC for bail, expressed desire to meet his ailing father.
Engineer Rashid: MP Engineer Rashid, who is jailed in the terror funding case, has approached the Delhi High Court for bail. Engineer Rashid, lodged in Delhi’s Tihar Jail, has sought interim bail to meet his ailing father. After receiving a blow from Patiala House Court, Patiala House Court has filed a petition in the High Court. The petition may be heard on Monday or Tuesday.
Engineer Rashid has sought interim bail of one month in view of the serious condition of his father Khizr Mohammad. His father is currently hospitalized and on ventilator (life support equipment).
In this case, NIA had earlier opposed the interim bail in the lower court. Citing security reasons, the agency had said that he should not be granted bail. However, the NIA had also indicated that Rashid may be granted custodial parole (allowed to meet while in custody). NIA’s lawyer argued in the court that Engineer Rashid can meet his father and family under custody parole even without bail, hence there is no need for interim bail.
Custody parole was granted in January
Earlier in January, Patiala House Court had given him custodial parole to attend the budget session of Parliament. During this period, he was allowed to participate in the proceedings of the Lok Sabha while in custody. At that time the court had also clarified who would bear the travel expenses during custody parole. This issue will depend on the decision of his appeal pending in the Delhi High Court.
It is noteworthy that Engineer Rashid is lodged in Tihar Jail since 2019 in the terror funding case of 2017. He has spent almost seven years in jail. Although after being elected MP, he took part in the proceedings of the Parliament session with the special permission of the court, but till now he has not been able to get regular bail or long-term interim bail.
