NCW issues advisory to states, UTs for strict enforcement of POSH Act across workplaces

The National Commission for Women (NCW) has issued a nationwide advisory to all States and Union Territories, calling for the immediate and effective implementation of measures under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013commonly known as the POSH Act.

The advisory aims to strengthen compliance with workplace safety regulations and promote a secure, inclusive and gender-sensitive environment for women across sectors.

Advisory sent to states and Union Territories

The Commission has formally communicated the advisory to the Chief Secretaries and Directors General of Police (DGPs) of all States and Union Territories. According to the NCW, the initiative seeks to ensure that institutions and organizations strictly adhere to the provisions of the POSH Act and establish mechanisms for prevention and redressal of workplace sexual harassment.

The Commission emphasized the need for coordinated action by administrative and law enforcement authorities.

Focus on all sectors and workplaces

The advisory covers workplaces across the government, private, organised and unorganised sectors. NCW said every workplace must comply with the provisions of the POSH Act and take necessary steps to create a safe and respectful working environment for women employees. The Commission stressed that workplace safety remains a critical component of women’s empowerment and participation in the workforce.

Push for grassroots-level implementation

To strengthen implementation at the local level, the advisory has also been circulated to District Magistrates, Senior Superintendents of Police (SSPs) and Commissioners of Police across the country. The move is intended to improve accountability and ensure that the provisions of the law are effectively enforced at the district and city levels. Officials have been urged to monitor compliance and facilitate awareness regarding the legal safeguards available to women.

Emphasis on prevention and redressal mechanisms

The NCW highlighted the importance of establishing and maintaining appropriate mechanisms for addressing complaints of workplace harassment. The Commission called for strict adherence to statutory requirements under the POSH Act, including the creation of institutional frameworks for prevention, prohibition and redressal. The advisory also underscores the need for organisations to foster gender-sensitive workplace cultures.

Strengthening workplace safety for women

The latest directive reflects the Commission’s continued focus on ensuring that women can work in safe and secure environments free from harassment and discrimination. By engaging state governments, police authorities and district administrations, the NCW aims to improve implementation of the POSH Act and strengthen institutional support systems across the country.

The Commission said effective enforcement of the law is essential for promoting dignity, equality and safety for women in workplaces nationwide.
