Order to give compensation of Rs 22.91 lakh to the family on the death of cyclist in Delhi road accident

Motor Accident Claims Tribunal in Delhi (MACT) has given a big verdict in a road accident case. The tribunal has ordered a compensation of Rs 22.91 lakh to the family of a cyclist who lost his life in a road accident in the year 2024. This case pertains to the death of cyclist Sushil Kumar, whose family had filed a petition demanding compensation. The case was heard by presiding officer Anurag Das. According to the information, Sushil Kumar died on 18 December 2024 in Chanchal Park area of ​​Ranhola, Delhi, when his bicycle collided with a motorcycle.

In its order dated June 9, the tribunal held that the petitioners had succeeded in proving that Sushil Kumar’s death was caused by the negligent driving of the motorcyclist Rajeev. Due to this negligence, the accident occurred and he suffered serious injuries. It came to light in the case that after the collision, Sushil Kumar was taken to the hospital in a critical condition, where the doctors declared him dead after examination. After this, a criminal case was also registered against the motorcycle driver. The tribunal, after a detailed study of eyewitness testimony, police records, FIR, chargesheet, site plan and mechanical inspection report, held that the accident was caused by negligent driving. The order said that it is clear from the available evidence that Sushil Kumar suffered serious injuries due to the collision with the motorcycle, which became the cause of his death.

What should the tribunal say?

The tribunal held that the accident occurred due to the negligence and rash driving of the motorcyclist. During the hearing, the tribunal also placed reliance on the testimony of an eyewitness, who runs a cycle repair shop near the spot. The witness stated that the motorcycle was coming at a very high speed and while taking a U-turn, it hit the cyclist. The tribunal said in its order that the collision with the cyclist was an indication that the vehicle was being driven at high speed and carelessly. On this basis, the court held that the motorcycle driver was responsible for the accident. While deciding the amount of compensation, the Tribunal (MACT) assessed the income of the deceased on the basis of minimum wages for unskilled workers in Delhi. During the hearing, no documents related to the income of the deceased were presented before the tribunal. In such a situation, the court calculated the compensation on the basis of available legal provisions and minimum wage rates. After considering all the aspects, the tribunal issued an order to pay a total compensation of Rs 22.91 lakh to the family of the deceased.
