What is the exact rule?
It is mandatory by law to do ‘Tenant Police Verification’ after renting out any flat, shop or residential space. It is mandatory for the landlord to register the complete personal and professional details of his tenant with the local police station. When and how is a direct crime filed?
If the landlord does not inform the local police about the tenant within a certain period of time after keeping him, it is considered a direct violation of the government order. From the point of view of the security of the country and the city, it is made mandatory for the local police administration to register the tenants. If the landlord violates this rule or refuses to do the police verification of the tenant, then the police take direct criminal action against the landlord. For this, a case is registered under Section 223 of the Indian Penal Code. Under this section, a case is registered against the landlord for disobeying a legal order issued by a government officer and a legal notice is sent. Also, if the tenant is found to be involved in any illegal or criminal act in the future, then for not informing the police, the landlord may also be considered a co-accused or suspect in that crime and may face direct arrest or legal action. Important stages of the legal process

Official Leave and License Agreement: When renting out a house, a legal ‘Leave and License’ agreement must first be entered into between the landlord and the tenant. It is considered illegal to make a simple paper or verbal transaction. This agreement should be officially registered with the Sub-Registrar’s office or through a recognized online system.
Legal deadline of 60 days: It is mandatory by law to register a tenant with the police within 60 days from the date of renting a house or flat, or from the date of signing the agreement . Failure to register after this deadline is considered a violation of the rules.
Document Collection: Before initiating the police verification, the landlord needs to collect the tenant’s Aadhaar card, PAN card, permanent address proof, passport size photograph, and the tenant’s office ID or business ID.
Registration at the police station or online: The landlord has to fill out the ‘Tenant Information Form’ at the local police station along with all the collected documents and a copy of the agreement. Currently, this process can be completed from home on the official online portal of Maharashtra Police. It is important to keep the official acknowledgement receipt received after the registration is completed.

Housing Society Permission: The verification certificate obtained from the police or the online registration receipt has to be submitted to the office of the concerned housing society. How to register online and offline?

Online Method: By visiting the official ‘City Citizen Portal’ of Maharashtra Police, homeowners can register by uploading the tenant’s Aadhaar card, PAN card, photo and workplace information from home.

What should be done as a precautionary measure?
To avoid any future legal troubles, landlords should obtain the PAN card, Aadhar card and the address of the previous landlord or office from the tenant before renting out the house.
